1. License
Subject to your compliance with these Terms, bitMachina grants you a limited, non-exclusive, non-transferable, revocable license to access and use our website, ATMs, counters, and OTC services for lawful personal or business purposes. This license does not include any right to resell or make commercial use of our services without our prior written consent, to copy or reproduce our software or platform, or to use any data mining, robots, or similar data gathering tools.
We reserve the right to suspend or revoke this license at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or our internal compliance policies.
2. Intellectual Property
All trademarks, logos, service marks, trade names, website content, graphics, and software associated with bitMachina are the property of bitMachina or its licensors and are protected by Canadian and international intellectual property laws. Nothing in these Terms transfers any ownership interest in this intellectual property to you.
You may not use bitMachina's name, logo, or branding in any way that suggests endorsement, partnership, or affiliation without our express prior written consent.
3. Forbidden Activities
You may not use bitMachina services to engage in, facilitate, or attempt any of the following: money laundering or terrorist financing; transacting on behalf of a third party without disclosure; using funds derived from illegal activity; attempting to structure transactions to evade reporting or verification thresholds; providing false, misleading, or stolen identification; or violating any applicable sanctions, export control, or anti-corruption law.
We reserve the right to refuse service, freeze funds pending investigation, and report suspicious activity to FINTRAC or other competent authorities as required by law.
4. Cancellation / Termination
bitMachina may suspend or terminate your access to any of our services at our discretion, including where we suspect fraud, non-compliance with these Terms, or a legal or regulatory obligation to do so. Where reasonably possible, we will provide notice of such action.
You may stop using our services at any time. Termination does not relieve either party of obligations that accrued prior to termination, including recordkeeping obligations we are required to maintain under applicable law.
5. AML/CTF Policy
bitMachina is registered with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a Money Services Business (registration number M20424579) and maintains a compliance program consistent with the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and its regulations.
Our program includes customer identification and verification procedures, ongoing transaction monitoring, recordkeeping, and the filing of large cash transaction reports, suspicious transaction reports, and other reports as required by law. Depending on transaction size and risk factors, we may request additional identification documents, source-of-funds information, or other supporting information before completing a transaction.
6. Daily / Order Limits
Transaction limits are tiered based on your verification status. As a sitewide default, unverified customers are limited to $995 CAD per day and verified customers are limited to $29,990 CAD per day; current figures are published on our Fees & Limits page and are subject to change without notice.
OTC desk trades are subject to a minimum trade size (currently $10,000 CAD) with no fixed upper cap, subject to internal risk review and available liquidity at the time of the trade.
7. Sanctions List
bitMachina does not knowingly provide services to individuals or entities located in, ordinarily resident in, or acting on behalf of persons in jurisdictions subject to comprehensive Canadian or international sanctions, including but not limited to Iran, North Korea, Russia, Syria, Venezuela, Yemen, and Zimbabwe.
We screen customers against applicable sanctions and watch lists as part of our onboarding and ongoing monitoring processes, and we reserve the right to decline or unwind any transaction connected, directly or indirectly, to a sanctioned jurisdiction, individual, or entity.
8. Refund Policy
Due to the irreversible nature of blockchain transactions, all completed transactions through bitMachina ATMs, counters, and OTC desks are final. Once cryptocurrency has been sent to the wallet address you provided, or cash has been dispensed, the transaction cannot be reversed, refunded, or cancelled.
It is your sole responsibility to verify wallet addresses, transaction amounts, and network selection before confirming any transaction. bitMachina is not responsible for funds sent to an incorrect address, an unsupported network, or a wallet you do not control.
9. Privacy, Consent & Data Collection
We collect personal information necessary to provide our services and to comply with our regulatory obligations, including identity documents, contact information, transaction history, and device or location information collected through our website, applications, and physical kiosks.
By using our services, you consent to our collection, use, and disclosure of your personal information as described in this policy and as required by applicable AML/CTF law. We retain records for the period required by law, currently a minimum of five years from the date of the relevant transaction or relationship, and we implement reasonable technical and organizational safeguards to protect your information.
10. Third-Party ID Verification Vendor & Geolocation Data Sharing
To verify your identity, we may share the personal information and identity documents you provide with third-party identity verification vendors who specialize in document authentication, biometric matching, and watchlist screening. These vendors process your information under contractual confidentiality and data protection obligations consistent with applicable Canadian privacy law.
Our ATMs and mobile-adjacent services may also collect approximate geolocation data (such as the location of the kiosk used or IP-based location signals) for fraud prevention, regulatory reporting, and service-area verification purposes. This data may be shared with our compliance vendors and, where legally required, with regulators or law enforcement.
11. Security Camera Notice
For the safety of our customers, staff, and hosting partners, and to support our fraud-prevention and compliance obligations, video surveillance is in operation at or near many of our physical ATM and counter locations. Recordings may be retained for a period consistent with applicable law and our internal retention schedule and may be shared with law enforcement or regulators in connection with an investigation.
12. Governing Law
These Terms and any dispute arising out of or relating to them or to your use of bitMachina services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any such dispute.
